Waiver of Liability and Release of Claims

This Waiver of Liability and Release of Claims(the "Waiver and Release") is entered into on the date indicated
below (the "Effective Date") by the undersigned party, hereinafter referred to as the "Participant."
WHEREAS, the Participant desires to engage in activities, including but not limited to boxing, fitness training,
and the use of gym equipment at Legendary Boxing Club, a boxing gym located at 7820 River Road East, in
Puyallup, Washington 98444, hereinafter referred to as the "Gym".
NOW, THEREFORE, for use of the Gym facility, and other good and valuable consideration, the receipt and
sufficiency of which are hereby acknowledged, the Participant agrees as follows:
Assumption of Risk: The Participant acknowledges and understands that engaging in boxing, fitness training,
and the use of gym equipment involve inherent risks and hazards. These may include, but are not limited to,
strains, sprains, fractures, contusions, concussions, brain injuries, abrasions, cuts, and other injuries that may occur
during the normal course of exercise or as a result of the actions of other attendees or trainers. Participant further
agrees that their use of the Gym is voluntary and that Participant assumes all risk of injury, the contraction of any
illness or medical condition, and any damage, loss, or theft of any personal property, including property in any
locked storage, whether any of the foregoing are suffered by Participant, Participant’s family members, or
Participant’s guests, and which may arise for any reason, including but not limited to the acts of other attendees,
and the negligence of Gym its owners, managers, employees, members, contractors, or agents (“Losses”).
Release of Liability: In consideration of being allowed to participate in the activities at the Gym, the Participant
hereby releases and discharges the Gym, its owners, trainers, employees, and any affiliated entities from any and
all claims, liabilities, demands, actions, or causes of action, whether in law or in equity, arising out of any injury,
disability, or death that may occur as a result of the Participant's participation in these activities.
To the maximum extent allowed by law, Participant agrees on their own behalf and on behalf of their family,
guests, personal representatives, heirs, executors, administrators, agents, and assigns, to waive and release any
and all claims, suits, or related causes of action against Gym, its members, managers, employees, or agents
(collectively, the “Released Parties”), for all Losses (“Released Claims”). PARTICIPANTACKNOWLEDGES
PARTICIPANT HAS CAREFULLY READ THIS WAIVER OF LIABILITY AND RELEASE OF
CLAIMS AND FULLY UNDERSTANDS ITS CONTENTS. PARTICIPANT IS WAIVING ANY RIGHT
PARTICIPANT MAY HAVE TO BRING A LEGAL ACTION TO ASSERT A CLAIM AGAINST GYM
FOR ITS NEGLIGENCE.
Participant agreesto indemnify, defend, and hold Gym harmless, to the maximum extent allowed by law, for any
claim, suit, action, related causes of action, Losses, and Released Claims asserted against Gym by anyone arising
from or out of Participant’s conduct, the conduct of Participant’s family, or the conduct of Participant’s guests,
whether it be willful, negligent, accidental, an omission, or otherwise.
Participant agreesto, and will comply with, the policies of Gym as written and acknowledges that these policies
are subject to change at the sole discretion of Gym.
This Waiver and Release shall bind Participant’sfamily members, spouse or registered domestic partner, guests,
estate, heirs, administrators, personal representatives, or assigns and shall be deemed as a release, waiver,
discharge, and covenant not to sue Gym. Participant agreesthat the purpose of this Waiver and Release is that it
shall be an enforceable release of liability and indemnity as broad and inclusive as is permitted by Washington
law. Participant agrees that if any portion or provision of this Waiver and Release is found to be invalid or
unenforceable, then the remainder will continue in full force and effect. Participant also agrees that any invalid

portion will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of
the Waiver and Release.
This Waiver and Release is governed by and shall be construed in accordance with the laws of the state of
Washington, without any reference to its choice of law rules. Participant agreesthat any dispute arising from this
Waiver and Release or in any way associated with Gym shall be brought only in Pierce County Superior Court.
In any litigation in which the validity or enforceability of this Waiver and Release is contested, Participant agrees
that the substantially prevailing party will be entitled to receive all attorney fees and costs from the party contesting
the validity of this Waiver and Release. This Waiver and Release encompasses the entire agreement of the parties,
and supersedes all previous understandings and agreements between the parties, whether oral or written.
Participant acknowledges that no oral representations, statements or other inducements to sign this Waiver and
Release have been made apart from what is contained in this document.
Waiver of Legal Rights: Participant understands and acknowledges that by signing this Waiver and Release, they
are waiving certain legal rights, including the right to sue the Gym for any injuries or damages that may occur.

Medical Fitness: Participant affirms that they are in good physical condition and have no medical or health-
related conditions that might increase the likelihood of injury during exercise. If the Participant has any concerns

about their health or fitness, they agree to consult with a physician before participating in any activities at the
Gym.
Photographic Release: Participant grants the Gym the right to use photographs and/or videos taken of them
during their time at the gym for promotional and marketing purposes, without compensation.
PARTICIPANT HAS FULLY INFORMED THEMSELVES OF THE CONTENTS OF THIS WAIVER AND
RELEASE BY READING IT BEFORE SIGNING IT. BY PARTICIPANT’S SIGNATURE BELOW,
PARTICIPANT UNDERSTANDS AND AGREES TO THE ABOVE TERMS AND CONDITIONS. THESE
POLICIES ARE SUBJECT TO CHANGE FROM TIME TO TIME SOLELY AT THE DISCRETION OF GYM.
IN WITNESS WHEREOF, the Participant hereto executesthis Waiver of Liability and Release of Claims as of
the Effective Date.
